Telemedicine has revolutionized the field of health care. It is increasingly emerging as a relevant solution to the challenges facing health systems. However, despite all these considerable advances and progress for humanity, telemedicine may be the source of many ethical and legal conflicts. In this work, we propose to study the legal framework of telemedicine in Tunisia in the light of comparative law and to analyse the ethical problems posed by the new information and communication technologies used in the field of health. To introduce the subject, we proposed to conduct a survey among surgeons working in three Tunisian university hospitals concerning the most commonly used telemedicine application in Tunisia, which is tele-medical assistance.
